Vienna court rejects injunction against Bwin

Bwin achieved a small victory in Austria this week as the Vienna Commercial Court rejected a preliminary injunction filed against it by Omnia Communication-Centers GmbH.

The injunction would have prevented Bwin, which owns and operates poker sites such as PokerRoom.com as well as casino sites, from offering games of chance in Austria.

"We welcome today's decision by the court to reject this application for a preliminary injunction," said co-CEO Norbert Teufelberger when he found out about the proceedings.

Though Bwin is licensed in Gibraltar, Omnia wanted to prevent it from operating in Austria under that license. However, the court dismissed the injunction based on the grounds that there's no competition between the two companies.

"We are in favor of a constructive dialogue to regulate the gaming market not only in the best interest of the consumer," said co-CEO Manfred Bodner, "but also in conformity with EU legislation and taking into account the realities of the Internet age."
