PokerTek hit with second lawsuit

Electronic card play innovator PokerTek is once again the subject of a lawsuit, just two months after a rival Pokermatic Inc. dropped its case against the company.

Tellis Software, Inc. has filed a multi-million dollar lawsuit against the PokerTek, the producer of card-less and dealer-less poker tables for casinos.

The Texas-based software development company is accusing PokerTek of breach of contract by failing to properly compensate Tellis for its work.

The suit alleges that PokerTek signed a contract with Tellis in 2004 to develop the software for its PokerPro electronic tables, the plaintiff said via a release from its attorney. In exchange for work, Tellis says PokerTek agreed to grant it equity in the company.

Once PokerTek received the software, Tellis alleges, it didn't offer the company full financial compensation.

Tellis is now seeking an unspecified amount of money in the multi-million dollar range for actual and punitive damages.

"In our view, PokerTek took Tellis' software without fully paying for it," said Tellis attorney Adam Loewy. "With this lawsuit, we hope that PokerTek finally compensates our client for the software, as they originally promised to do."
